Commercial clause
INFORMATION CLAUSE
Pursuant to Art. 13 section 1 and section 2 of the general regulation on personal data protection of 27 April 2016 please be informed that:
1) FABRYKA MEBLI BALMA S.A. with registered office in: ul. Poznańska 167, 62-080 Tarnowo Podgórne is the Administrator of your personal data.
2) The Administrator has appointed Data Protection Officer, e-mail: iodo@balma.pl
3) Your data is processed exclusively to take action prior to concluding an agreement at the request of the data subject or to execute an agreement that the data subject is a party to as well as to enter into a sales agreement on the basis of your interest in the products we offer.
4) The recipients of your personal data are authorised persons only. We may transfer your data to Authorised Sales Representatives and Company Showrooms, and also to Carriers with whom we have signed agreements concerning personal data protection. We do not sell your data or share it with unauthorised persons.
5) Your data may be transferred to a country which does not belong to the European Economic Area (a third country) or an international organisation within the meaning of the GDPR as part of entrusting the processing of personal data or making it available by the power of legal regulations, yet always under one of the following conditions:
-
- the European Commission has stated that this third country or international organisation can ensure the adequate level of personal data protection pursuant to Art. 45 of the GDPR
- a third country or an international organisation ensure proper protection and enforceable rights of data subjects and effective means of law protection apply there pursuant to Art. 46 of the GDPR
- the case referred to in Art. 49 section 1 par. 2 of the GDPR occurs
6) Your personal data processed in order to conclude or execute an agreement shall be stored for no longer than it is needed, i.e. during the period necessary to:
a. execute a sales agreement and after-sales customer service (e.g. handling complaints)
b. secure or vindicate possible claims
c. fulfil the Administrator’s legal obligation (e.g. resulting from accounting or tax regulations)
7) You have the right to access the content of your data and the right to correct it, delete, limit the processing, the right to transfer the data, the right to lodge an objection, the right to withdraw at any time the consent with no effect on the compliance with the law of the processing performed on the basis of the consent before its withdrawal.
8) You have the right to file a complaint with GIODO (the Inspector General for Personal Data Protection) when you recognise that the processing of your personal data violates the provisions of the general regulation on personal data protection of 27 April 2016.
9) Providing personal data is voluntary, however, the refusal to provide the data shall make the concluding and executing of the Agreement not possible.
10) Your data will be processed in an automated manner, including profiling, however, it shall not bear any legal consequences for you or in a similar way significantly affect your situation.
